I have just been elected to serve on my child’s pre-school committee and other committee members have told me that I need to have a CRB check. Is this correct?
Early Year settings registered with Ofsted on either the Early Years Register or the Childcare Register Compulsory and Voluntary sections will need to ensure that all trustees (committee) members meet the requirements of the Early Years Foundation Stage. Ofsted must check the suitability of the registered provider, which in the case of voluntary-run pre-schools is the trustees of the early years setting.
Trustees will need to fill out a declaration and consent form (EY2) which can be obtained from your local authority or downloaded from Ofsted's website. The EY2 form asks for a self-declaration of criminal records and other matters that determine suitability to work with or be in contact with children. Once each committee member has filled out a EY2, the forms should be sent to Ofsted who will carry out the checks.
Each committee member will need to apply for an Enhanced Disclosure, which is carried out by the Criminal Records Bureau. Enhanced Disclosures contain the same information as Standard Disclosures but with the addition of local police force information considered relevant by Chief Police Officer(s).
The CRB recognises that the Enhanced Disclosure information can be extremely sensitive and personal; therefore it has published a Code of Practice and employers' guidance for recipients of Disclosures to ensure they are handled fairly and used properly.
A copy of the Enhanced Disclosure will be sent out to the applicant as well as to Ofsted. All changes to the trustees must be notified to Ofsted, the trustees will need to fill out a notification form (EY3) which informs Ofsted of a change to the "Registered Person or Provider".
All new committee members will need to fill out a EY2 form.
